1. Acceptance of these terms
These terms are an agreement between you and Midnight Holdings LLC, a Wyoming limited liability company in the United States that operates as Midnight Apps, which provides RemoteJobs. In these terms and in the other RemoteJobs legal documents, "we", "us" and "our" mean Midnight Holdings LLC. These terms govern your use of the RemoteJobs mobile application and https://midnightapps.dev/remotejobs/. By creating an account or using the app, you agree to them. If you do not agree, do not use the service. We record the version of these terms you accepted, together with the date, the app version and your selected language and country, so that both of us have a record of what you agreed to.
2. What RemoteJobs is
RemoteJobs is a job-discovery application. It collects remote job announcements from third-party sources, screens and reviews them, and presents them to you so you can find and apply for work. RemoteJobs is not an employer, not a recruiter, not a staffing agency and not a party to any application, interview, offer or employment relationship. Applications are made on the employer's own website or applicant-tracking system, not through this app; where the app records an application, that record is your own tracking note and is not transmitted to the employer.
3. Eligibility and accounts
You must meet the minimum age for your country to hold an account; the app applies a per-country minimum, which ranges from 13 to 18 depending on the country. You must provide accurate registration information, keep your password confidential, and are responsible for activity under your account. Email verification is required before you can reach the main app. You may sign in with an email address and password, or with a Google account where that option is offered. You may delete your account yourself at any time from Profile, then Delete account.
4. Subscriptions and paid features
Some job data is available only to subscribers. Subscriptions are sold and billed by the Apple App Store or Google Play, not by us, and are governed additionally by that store's terms. Entitlement is verified on our servers, so access reflects what the store has actually confirmed. See the Subscription and Billing Terms and the Cancellation and Refund Policy for the details.
5. Acceptable use
You may use RemoteJobs to find work for yourself. You may not scrape, bulk-export, resell or redistribute listing data; attempt to bypass the subscription entitlement checks; probe or interfere with the security of the service; submit false reports about employers or listings; or use the service to send unsolicited messages. The Acceptable Use Policy sets this out in full.
6. Content and intellectual property
The application, its interface, and its name and logo belong to us or our licensors. Job announcements, employer names and employer logos belong to the employers and sources they come from, and are displayed for the purpose of helping you find and apply for those jobs. You keep ownership of what you put into the app — your profile details, preferences, notes and any documents you add.
7. No guarantee of listings, outcomes or employment
We do not guarantee that any listing is accurate, complete, current or still open, that any employer will respond to you, that you will be interviewed or hired, or that the app lists every remote job in any market. Listings come from third parties and can change or close without notice. The Job Listing Disclaimer explains how we check freshness and what that check does and does not prove.
8. Suspension and termination
We may suspend or terminate access for breach of these terms, for suspected fraud or abuse, or where required by law. You may stop using the service and delete your account at any time. Provisions that by their nature should survive termination — including limitation of liability, and the retention described in the Privacy Policy — continue to apply.
9. Disclaimers and limitation of liability
The service is provided on an "as is" and "as available" basis, without warranties of any kind except those that cannot lawfully be excluded. To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential loss, for lost earnings or lost opportunities, or for the acts or omissions of any employer, source or other third party. Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be limited — including consumer rights that apply to you regardless of contract.
10. Changes to these terms
We may update these terms. Where a change is material we will make the updated version available in the app and, where required, ask you to accept it again before continuing. Continuing to use the service after a non-material change means you accept it.
11. Governing law and disputes
The law that governs these terms and the courts that have jurisdiction over disputes about them will be stated in this section; they have not yet been chosen and are not assumed in this draft. Whatever is chosen, it is subject to the mandatory consumer-protection law of your country of residence.
